Inheriting property in Minnesota usually involves probate court, which ensures debts are paid and assets are distributed as intended. This process typically involves filing a petition with the court by a designated personal representative. The court validates the will (if one exists), identifies and values assets, settles debts, and oversees distribution to beneficiaries. It can take 12-18 months on average.
There are two types of probate – Formal and Informal.
Informal probate - An informal application can be filed to ask the court to appoint a personal representative without a hearing in front of a judge in situations that are less complicated.
Formal probate - A formal petition can be filed to ask the court to appoint a personal representative with a hearing in front of a judge in situations that may be more complicated.
However, you might be able to avoid probate if the total value of the deceased's estate is less than $75,000. In such cases, Minnesota law allows using an "Affidavit for Collection of Personal Property" to collect the assets without court involvement. This simplifies the process and reduces time and potential costs associated with probate.
